These Terms & Conditions ("Terms") govern your use of the website sacketsharborballroom.com (the "Site") and our text-messaging program. The Site is operated by Sackets Harbor Ball Room LLC, doing business as Sackets Harbor Ballroom ("Sackets Harbor Ballroom," "we," "us," or "our"), 103 W Main St, Sackets Harbor, NY 13685. By using the Site or opting in to receive text messages, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Site.
1. Use of the Site
You may use the Site to learn about our venue, view event packages, and submit inquiries. You agree not to use the Site for any unlawful purpose, to submit false or misleading information, to interfere with the Site's operation, or to attempt to gain unauthorized access to any part of the Site or its systems.
2. Inquiries Are Not Bookings
Submitting an inquiry, proposal request, or party request through the Site does not reserve a date or create a binding booking. A booking is confirmed only when a written venue agreement is signed by both parties and any required deposit has been received. Pricing, packages, and availability shown on the Site are subject to change without notice until a written agreement is signed.
3. Text Messaging (SMS) Terms
Program description. When you opt in, Sackets Harbor Ballroom may send you text messages related to your event inquiry and booking, including replies to your questions, proposal and quote follow-ups, tour and consultation confirmations, booking and deposit confirmations, event-day logistics reminders, and occasional announcements about public events at the Ballroom.
How you opt in. You can opt in by checking the SMS consent box on one of our website inquiry forms, or by providing your mobile number and verbal consent to our staff during a tour, consultation, or booking. Checking the box is voluntary and is never pre-selected for you.
Consent is not a condition of purchase. You do not have to agree to receive text messages to inquire about, tour, or book the Ballroom.
Message frequency. Message frequency varies based on your inquiry and event; up to 6 messages per month.
Message and data rates may apply. Standard message and data rates from your wireless carrier may apply to messages you send and receive. Check with your carrier for details on your plan.
How to opt out. Reply STOP to any message at any time to cancel. You will receive one final confirmation message and no further texts from us. You may also opt out by calling 315-646-7145 or emailing sacketsharborballroom@gmail.com.

Supported carriers. Messages are supported on major U.S. carriers, including AT&T, T-Mobile, Verizon, and their affiliates. Carriers are not liable for delayed or undelivered messages.
Your mobile number. You represent that you are the owner or authorized user of the mobile number you provide and that you are at least 18 years old. If you change or deactivate your number, please notify us so we can update or remove it.
Privacy. We do not sell or share your mobile phone number or SMS opt-in information with any third parties or affiliates for their marketing or promotional purposes. See our Privacy Policy for details.
4. Intellectual Property
All content on the Site, including text, photographs, logos, graphics, and design, is owned by or licensed to Sackets Harbor Ballroom and is protected by copyright and trademark law. You may not copy, reproduce, distribute, or create derivative works from Site content without our prior written permission, except for personal, non-commercial viewing.
5. Third-Party Links and Services
The Site may contain links to third-party websites and embedded third-party services (such as social media, maps, and inquiry forms). We do not control and are not responsible for the content, availability, or privacy practices of third-party sites and services. Your use of them is at your own risk and subject to their terms.
6. Disclaimer of Warranties
The Site and its content are provided "as is" and "as available" without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or free of viruses or other harmful components.
7. Limitation of Liability
To the fullest extent permitted by law, Sackets Harbor Ball Room LLC and its owners, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of the Site or the text-messaging program. Our total liability for any claim relating to the Site will not exceed one hundred dollars ($100). Nothing in these Terms limits liability that cannot be limited under applicable law. Liability relating to a venue booking is governed by the signed venue agreement, not these Terms.
8. Indemnification
You agree to indemnify and hold harmless Sackets Harbor Ball Room LLC and its owners, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your violation of these Terms or your misuse of the Site.
9. Governing Law and Venue
These Terms are governed by the laws of the State of New York, without regard to its conflict-of-law rules. Any dispute arising out of or relating to these Terms or the Site shall be brought exclusively in the state or federal courts located in Jefferson County, New York, and you consent to the personal jurisdiction of those courts.
10. Changes to These Terms
We may revise these Terms at any time by posting an updated version on the Site with a new "Last updated" date. Your continued use of the Site or the text-messaging program after changes are posted constitutes acceptance of the revised Terms.
11. Severability
If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force and effect.
